CG Market Terms of Service
These Terms govern your access to and use of the CG Market website and services.
1. Introduction
Welcome to CG Market. These Terms of Service ("Terms") govern your access to and use of the CG Market website and services ("Site"). By creating an account or using the Site, you agree to comply with these Terms. If you do not agree, you must not use CG Market. CG Market is an online marketplace for digital 3D content, including but not limited to 3D models, textures, plugins, motion files, and scripts. We permit both free and paid content, including AI-generated models, provided they are clearly labeled as such for transparency.
2. Definitions
- Site: Refers to the CG Market website (www.cgmarket.com).
- User or Member: Any person or entity who creates an account on the Site.
- Seller: A User who uploads or offers digital content ("Products") for sale or free download.
- Buyer: A User who purchases or downloads a Product.
- Product: Any digital material uploaded to the Site (3D models, textures, animations, etc.).
- Account: The User’s registration and profile on CG Market.
3. Account Eligibility and Responsibilities
- Eligibility: You must be at least 18 years old. By registering, you represent that you meet this age requirement.
- Information: You agree to provide accurate information and are responsible for all activities under your Account.
- Use: You must use the Site in compliance with applicable laws. Misconduct may lead to account suspension.
4. CG Market Marketplace Role
CG Market functions as a platform to facilitate transactions. Unless explicitly stated, CG Market is not the seller of the Products; the license agreement exists directly between the Seller and the Buyer. All payments and downloads must be completed through the Site. Attempting to bypass the marketplace for off-site transactions may result in account termination.
5. Seller Terms and Content Submission
- Ownership: Sellers retain ownership of the copyright to their content.
- Right to Upload: You represent and warrant that you own all IP rights or have obtained all necessary permissions.
- AI-Generated Content: Permitted provided it is clearly identified and does not violate existing copyrights.
- Prohibited Content: No illegal, defamatory, or harmful content is allowed.
- License Grant to CG Market: You grant CG Market a non-exclusive, worldwide license to host and promote your content.
6. Buyer Terms and Content Usage License
Buying a Product grants a license, not ownership.
- Scope: Non-exclusive, non-transferable, worldwide license.
- Incorporated Product: You may use content in films or games if the end-user cannot extract the original file.
- No Resale: You may not sell or share the Product as a standalone item.
- Editorial Use: Products marked "Editorial" are restricted to non-commercial use.
7. Payments, Fees, and Refunds
- Pricing: Prices are set by Sellers. CG Market handles applicable taxes.
- Refunds: Digital products are generally final sale. Refunds may be considered within 7 days for technical defects.
8. Legal and Liability Provisions
- IP Infringement: Report claims to paul@cgmarket.com.
- Limitation of Liability: Liability is limited to the amount paid for a Product or $100.00 USD.
- Indemnification: You agree to hold CG Market harmless from claims arising from your use of the Site.
- Governing Law: Governed by the laws of the Province of British Columbia, Canada. Disputes will be handled in British Columbia courts.
